I don't think it would qualify, yet. None of the problems have been the result of faulty manufacture. The dealer has addressed the problems done repairs under warranty. It's a lemon if the same problem is either unfixable or chronically reoccuring. My problem lies in the quality of their facility and their inability to get this problem fixed. The driveshaft hitting the exhaust is a bit worrysome, though.
